The claims were raised by ICS “Moldcell” S.A. under the old Law on Protection of Competition, referring to a promotion conducted by Moldtelecom back in 2011. According to Moldcell, Moldtelecom allegedly applied low monopolistic prices, which was prohibited by Article 6 letter g) of the old Law on Protection of Competition.
Competition Council determined that the ‘relevant market’ was the retail mobile services market on the entire territory of Moldova. Further, the Competition Council found that Moldtelecom was not holding a dominant position on the relevant market during 2011, and that Moldtelecom did not eliminate its competitors on that market when implementing the promotion under investigation.
