
Data Protection – what are businesses concerned of?
ACI Partners, top law firm in Moldova, along with the National Center for Personal Data Protection has contributed to the Knowledge Seminar on Personal Data Protection organised for the members of the HR and Tax & Legal Committees of AmCham.
Marina Zanoga, ACI Partners Attorney-at-Law, delivered a presentation “Processing of Personal Data” to the senior staff of the AmCham members.
The agenda of the seminar included:
- analysis of the present data protection legal framework;
- explanation of the key concepts and principles, actors and roles;
- latest developments and challenges in the field of personal data processing and protection.
Privacy issues are being a rather hot topic recently in Moldova following the international trend. Every day we deal with privacy issues being either those whose personal data is used or those who use such data. Legally speaking we are either data subjects or controllers.
Video surveillance, whistle-blowing lines, processing of your clients’ and employees’ information, cross-border transfer, intra-group and externally – these are just few examples when we face the strict rules of data protection regulations. What should the employers be aware of, what are their rights and duties? These were the concerns addressed by the speakers during the seminar.
The seminar had a practical focus, covering less theory but more those issues concerning business on a daily basis. Because of the interactive format of the seminar, participants were free to address any questions. Most of questions referred to the following:
- notification procedure and documents to be submitted;
- confidentiality and obligation of a data controller to disclose certain information without data subject’s consent;
- applicability of the principles of data processing: (a) obtained only for one or more specified and lawful purposes; (b) personal data shall be adequate, relevant and not excessive in relation to the purpose or purposes for which they are processed;
- cross border transfer: many participants are members of international groups and were interested in the particularities of data transfer especially in the USA which is considered unsafe destination;
- term of personal data retention.
